14.1 Informal Resolution

If the dispute cannot be resolved through informal means within this period, either party may proceed to binding arbitration as described below.

EXCEPT AS OTHERWISE PROVIDED IN SECTION 14.4, YOU AND PAPA GINOS AGREE TO RESOLVE ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE THROUGH FINAL, BINDING ARBITRATION, RATHER THAN IN COURT. The arbitration shall be conducted by a recognized arbitration organization under its then-current rules. The arbitration shall take place in the jurisdiction where Papa Ginos is based, or at such other location as may be mutually agreed upon by the parties. The arbitration shall be conducted in the English language.

The arbitrator shall have the authority to award any remedy that would be available in a court of competent jurisdiction. The arbitrator's decision shall be final and binding and may be confirmed and enforced in any court of competent jurisdiction. The costs of arbitration shall be allocated in accordance with the applicable arbitration rules and applicable law, including the Federal Arbitration Act (9 U.S.C. § 1 et seq.).

14.3 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. IF A COURT OR ARBITRATOR FINDS THAT THIS CLASS ACTION WAIVER IS UNENFORCEABLE, THEN THE AGREEMENT TO ARBITRATE SHALL BE NULL AND VOID WITH RESPECT TO THAT DISPUTE.
